{"id":22604,"date":"2017-11-06T12:37:38","date_gmt":"2017-11-06T17:37:38","guid":{"rendered":"https:\/\/www.tun.com\/blog\/?p=22604"},"modified":"2022-12-14T16:57:34","modified_gmt":"2022-12-14T21:57:34","slug":"work-in-the-u-s-m-1-visa","status":"publish","type":"post","link":"https:\/\/www.tun.com\/blog\/work-in-the-u-s-m-1-visa\/","title":{"rendered":"Working in the USA with M-1 Student Visa"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Unlike students with <\/span><a href=\"https:\/\/www.tun.com\/blog\/study-in-the-us-f-1-student-visa\/\"><span style=\"font-weight: 400;\">F-1 visas<\/span><\/a><span style=\"font-weight: 400;\"> who may be eligible to work during their program of study under certain conditions, students with <\/span><a href=\"https:\/\/www.tun.com\/blog\/study-in-the-us-m-1-student-visa\/\"><span style=\"font-weight: 400;\">M-1 visas<\/span><\/a><span style=\"font-weight: 400;\"> are not allowed to work on or off campus while they are pursuing their program of study. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Students with M-1 visas are also restricted when it comes to practical training. While <a href=\"https:\/\/www.tun.com\/blog\/work-in-the-u-s-f-1-visa\/\" target=\"_blank\" rel=\"noopener noreferrer\">students with F-1 visas have various training options<\/a>, including an option for pre-completion optional practical training, students with M-1 visas have access to just one type of practical training (PT) employment, which is available only after they complete their vocational program to give them training experience in their vocational field. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Any PT must be recommended by a designated school official (DSO) and authorized by the<\/span> <a href=\"https:\/\/www.uscis.gov\/working-united-states\/students-and-exchange-visitors\/students-and-employment\"><span style=\"font-weight: 400;\">U.S. Citizenship and Immigration Services (USCIS)<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you work without authorization, you will violate the terms of your M-1 student visa and fall out of status. Once you fall out of status, you will be forced to leave the United States.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To avoid falling out of status, make sure you know the rules before you start working.\u00a0<\/span><\/p>\n<h2><b>Practical training<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The duration of PT employment <\/span><a href=\"https:\/\/studyinthestates.dhs.gov\/training-opportunities-in-the-united-states\"><span style=\"font-weight: 400;\">depends<\/span><\/a><span style=\"font-weight: 400;\"> on the individual student\u2019s program of study. For every four months of full-time study, M-1 students will be eligible for one month of PT with a maximum of six months. For example, M-1 students enrolled in a 12-month full-time program will be eligible for only three months of PT.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To <\/span><span style=\"font-weight: 400;\">qualify for PT employment, M-1 students must show the following:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Their chosen PT is <\/span><b>directly related<\/b><span style=\"font-weight: 400;\"> to their program of study;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They have <\/span><a href=\"https:\/\/www.uscis.gov\/ilink\/docView\/SLB\/HTML\/SLB\/0-0-0-1\/0-0-0-11261\/0-0-0-17197\/0-0-0-19221.html\"><span style=\"font-weight: 400;\">completed their program of study<\/span><\/a><span style=\"font-weight: 400;\"> at a school certified by the <\/span><a href=\"https:\/\/studyinthestates.dhs.gov\/school-search\"><span style=\"font-weight: 400;\">Student and Exchange Visitor Program (SEVP)<\/span><\/a><span style=\"font-weight: 400;\">; and<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">They have valid M-1 student status.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If you are an M-1 student and want to learn more about your training eligibility, you should speak with your DSO. You should also determine at this time if you need to apply to USCIS for an <\/span><a href=\"https:\/\/studyinthestates.dhs.gov\/m-1-extensions-of-stay\"><span style=\"font-weight: 400;\">extension of status<\/span><\/a><span style=\"font-weight: 400;\"> at the same time you apply for PT authorization, since M-1 students are admitted to the United States only until a certain date.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Here\u2019s what you need to do to <span style=\"color: #ff0000;\">get authorization for PT<\/span>:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You must obtain your DSO\u2019s approval. Your DSO can authorize PT employment for you in the <\/span><a href=\"https:\/\/www.ice.gov\/sevis\"><span style=\"font-weight: 400;\">Student and Exchange Visitor Information System (SEVIS)<\/span><\/a><span style=\"font-weight: 400;\"> and provide you with an updated <\/span><a href=\"http:\/\/studyinthestates.dhs.gov\/student-forms?form=Form_I-20\"><span style=\"font-weight: 400;\">Form I-20 M\/N<\/span><\/a><span style=\"font-weight: 400;\">, \u201cCertificate of Eligibility for Nonimmigrant (M-1) Student Status &#8212; For Vocational Students,\u201d <\/span><span style=\"font-weight: 400;\">that shows DSO approval for PT employment.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Once you have the new Form I-20 M-N, you must file a <\/span><a href=\"https:\/\/www.uscis.gov\/i-765\"><span style=\"font-weight: 400;\">Form I-765<\/span><\/a><span style=\"font-weight: 400;\">, \u201cApplication for Employment Authorization,\u201d along with a <\/span><a href=\"https:\/\/www.uscis.gov\/i-539\"><span style=\"font-weight: 400;\">Form I-539<\/span><\/a><span style=\"font-weight: 400;\">, \u201cApplication to Change\/Extend Nonimmigrant Status,\u201d if necessary, within 30 days of receiving your recommendation. You must also pay the requisite fee to USCIS.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">If USCIS approves your application, you will receive a <\/span><a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/employment-authorization-document\"><span style=\"font-weight: 400;\">Form I-766<\/span><\/a><span style=\"font-weight: 400;\"> (EAD), which will specify the dates that you may work. Please note that you may not commence PT employment before you receive your EAD.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>How far in advance can you get the process going? <\/strong><\/p>\n<p><span style=\"font-weight: 400;\">You may apply up <\/span><span style=\"font-weight: 400;\">to 60 days before you complete your program of study, but you may not start working until after you complete your studies. The deadline for application is 30 days after completing your program of study.<\/span><\/p>\n<h2><b>Program post-completion caveat<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">What should M-1 students do after completing their program?<\/span><\/p>\n<p><b>Always be mindful to maintain your visa status. <\/b><span style=\"font-weight: 400;\">If you are on an M-1 visa and have completed your program of study and any authorized period of PT, you have 30 days after the program end date on your Form I-20 to leave the United States. The latest date you may remain in the United States is the \u201cadmit until\u201d date on your <\/span><a href=\"http:\/\/studyinthestates.dhs.gov\/student-forms?form=Form_I-94\"><span style=\"font-weight: 400;\">Form I-94, \u201cArrival\/Departure Record,\u201d<\/span><\/a><span style=\"font-weight: 400;\"> unless you filed for an extension with USCIS.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you wish to <span style=\"color: #ff0000;\">extend your stay<\/span> without violating your status, you should talk to your DSO and consider other options, such as transferring to another school, changing the level of education you are pursuing, and\/or changing your visa status.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Unlike students with F-1 visas who may be eligible to work during their program of study under certain conditions, students with M-1 visas are not allowed to work on or off campus while they are pursuing their program of study.
