{"id":22596,"date":"2017-11-06T12:24:54","date_gmt":"2017-11-06T17:24:54","guid":{"rendered":"https:\/\/www.tun.com\/blog\/?p=22596"},"modified":"2022-12-14T16:58:07","modified_gmt":"2022-12-14T21:58:07","slug":"work-in-the-u-s-f-1-visa","status":"publish","type":"post","link":"https:\/\/www.tun.com\/blog\/work-in-the-u-s-f-1-visa\/","title":{"rendered":"Working in the USA with F-1 Student Visa"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Students with an <\/span><a href=\"https:\/\/www.tun.com\/blog\/study-in-the-us-f-1-student-visa\/\"><span style=\"font-weight: 400;\">F-1 student visa<\/span><\/a><span style=\"font-weight: 400;\"> should not commence work, either on or off campus, without first consulting their designated school official (DSO). Authorization to work is required either from the DSO or the <\/span><a href=\"https:\/\/www.uscis.gov\/working-united-states\/students-and-exchange-visitors\/students-and-employment\"><span style=\"font-weight: 400;\">U.S. Citizenship and Immigration Services (USCIS)<\/span><\/a><span style=\"font-weight: 400;\">. If you work without authorization, you will violate the terms of your F-1 student visa and fall out of status. Once you fall out of status, you will be forced to leave the United States.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To avoid falling out of status, make sure you know the rules before you start working.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Here is a summary of the various types of work programs available to F-1 students.<\/span><\/p>\n<h2><b>1. Working on campus<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">F-1 students are not allowed to work off campus during their first academic year, but they may work <\/span><a href=\"https:\/\/www.ice.gov\/sevis\/employment\"><span style=\"font-weight: 400;\">on campus<\/span><\/a><span style=\"font-weight: 400;\"> under certain conditions. <\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>First<\/strong>, jobs must qualify as on-campus jobs, which means:<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\">Jobs must be located at the student\u2019s school and directly involve services to students, such as a bookstore or cafeteria.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Jobs could be located at an off-campus location, but still fall under on-campus employment, if the work is associated with the school\u2019s established curriculum OR the employer has a contractual affiliation with the school (for example, a research lab affiliated with your school).<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\"><strong>Second<\/strong>, F-1 students are allowed to take on-campus jobs only if their employment does not take the jobs away from a U.S. citizen or lawful permanent resident (LPR).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">F-1 students are allowed to start their on-campus jobs as early as 30 days before the start of a program of study. The <span style=\"color: #ff0000;\">maximum<\/span> number of hours you can work per week is 20 hours, but you may work full-time when school is NOT in session<\/span><span style=\"font-weight: 400;\">, i.e., during school breaks and annual vacation<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You will need to obtain certification letters from your DSO and the employer, so you can apply for a <\/span><a href=\"https:\/\/studyinthestates.dhs.gov\/obtaining-a-social-security-number\"><span style=\"font-weight: 400;\">Social Security Number<\/span><\/a><span style=\"font-weight: 400;\">* that\u2019s needed for you to work. <\/span><\/p>\n<p><b>*Note:<\/b><span style=\"font-weight: 400; color: #ff0000;\"> Every student with F-1 visa who is authorized to work in the United States needs a Social Security Number.<\/span><\/p>\n<h2><b>2. Working off campus<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">F-1 students with severe economic hardships may be allowed to <\/span><a href=\"https:\/\/www.ice.gov\/sevis\/employment\"><span style=\"font-weight: 400;\">work off campus<\/span><\/a><span style=\"font-weight: 400;\"> for up to 20 hours per week. Such students may work full-time when school is not in session.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To qualify for off-campus employment based on severe economic hardship, you must meet the following conditions:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You have completed at least one full academic year of your program of study;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You have valid F-1 student status; <\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You are in good academic standing;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You can prove that you have severe economic hardship resulting from new, unexpected circumstances beyond your control; and<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">You must demonstrate that you have tried and was unable to secure on-campus employment, or that the pay from available on-campus employment is insufficient to meet your financial needs.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">What <span style=\"color: #ff0000;\">counts as severe economic hardship<\/span> caused by unforeseen circumstances beyond your control? According to USCIS, it would include:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Loss of financial aid or on-campus job for which you are not at fault;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Substantial increase in tuition or living costs;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Substantial decrease in currency value;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Unexpected changes in the financial conditions of your sources of financial support;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Large medical bills that are not covered by insurance; and<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">Other substantial, unexpected expenses.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Here\u2019s what you <span style=\"color: #ff0000;\">need to do to get authorization<span style=\"color: #000000;\"> to work off-campus based on undue hardship:<\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You should talk to your DSO and explain why you need it. Your DSO can then recommend you for off-campus employment and provide you with an updated <\/span><a href=\"http:\/\/studyinthestates.dhs.gov\/student-forms?form=Form_I-20\"><span style=\"font-weight: 400;\">Form I-20<\/span><\/a><span style=\"font-weight: 400;\">, \u201cCertificate of Eligibility for Nonimmigrant Status.\u201d <\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Once you have the new Form I-20, you must file a <\/span><a href=\"https:\/\/www.uscis.gov\/i-765\"><span style=\"font-weight: 400;\">Form I-765<\/span><\/a><span style=\"font-weight: 400;\">, \u201cApplication for Employment Authorization,\u201d within 30 days of receiving your recommendation. You must also pay the requisite fee to USCIS.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If USCIS approves your application, you will receive a <\/span><a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/employment-authorization-document\"><span style=\"font-weight: 400;\">Form I-766<\/span><\/a><span style=\"font-weight: 400;\">, \u201cEmployment Authorization Document\u201d (EAD), which will specify the dates that you may work off-campus.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The authorized period is usually for a <span style=\"color: #ff0000;\">maximum period of one year<\/span>. If you need to continue to work off-campus after the authorized period, you must submit another application.<\/span><\/p>\n<h2><b>3. Practical training<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">After completing their first academic year, F-1 students have three options when it comes to practical training, which are intended to provide students with valuable work experience.<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Curricular Practical Training<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Optional Practical Training<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">Science, Technology, Engineering and Mathematics (STEM) Optional Practical Training Extension<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3 style=\"padding-left: 40px;\"><b>A. Curricular Practical Training<\/b><\/h3>\n<p><a href=\"https:\/\/www.ice.gov\/sevis\/practical-training\"><span style=\"font-weight: 400;\">Curricular practical training (CPT)<\/span><\/a><span style=\"font-weight: 400;\"> is an option only when the employment is <\/span><b>part of<\/b><span style=\"font-weight: 400;\"> your program of study. So check with your DSO to find out your school\u2019s CPT policy. Examples of CPT employment include: alternative work\/study, internship, cooperative education, or other type of required practicum offered by an employer who has cooperative agreements with your college or university. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">CPT is available for eligible undergraduate and graduate students. You are <\/span><b>allowed to work full-time<\/b><span style=\"font-weight: 400;\"> under this program.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To <span style=\"color: #ff0000;\">qualify for CPT employment<\/span>, you must show the following:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">CPT is integral to your program of study.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You have completed at least one full academic year of your program of study at a school certified by the <\/span><a href=\"https:\/\/studyinthestates.dhs.gov\/school-search\"><span style=\"font-weight: 400;\">Student and Exchange Visitor Program (SEVP)<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><i><span style=\"font-weight: 400;\">if you are an undergraduate<\/span><\/i><span style=\"font-weight: 400;\">;*<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You have valid F-1 student status; and<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">You have a signed cooperative agreement or a letter from your employer.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><b>*Note<\/b><span style=\"font-weight: 400;\">: <span style=\"color: #ff0000;\">If you are an F-1 <\/span><\/span><span style=\"color: #ff0000;\"><i><span style=\"font-weight: 400;\">graduate<\/span><\/i><span style=\"font-weight: 400;\"> student, you are eligible for CPT employment during your first semester, provided that your program requires such experience.<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you\u2019re interested in CPT employment, you should talk to your DSO and find out your school\u2019s CPT policy. Your DSO can then authorize a CPT employment for you in the <\/span><a href=\"https:\/\/www.ice.gov\/sevis\"><span style=\"font-weight: 400;\">Student and Exchange Visitor Information System (SEVIS)<\/span><\/a><span style=\"font-weight: 400;\"> and provide you with an updated <\/span><a href=\"http:\/\/studyinthestates.dhs.gov\/student-forms?form=Form_I-20\"><span style=\"font-weight: 400;\">Form I-20<\/span><\/a><span style=\"font-weight: 400;\">, \u201cCertificate of Eligibility for Nonimmigrant Status,\u201d <\/span><span style=\"font-weight: 400;\">that shows DSO approval for CPT employment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Keep in mind though that you won\u2019t be eligible for any OPT (see below) if you have 12 months or more of full-time CPT. <\/span><\/p>\n<h3 style=\"padding-left: 40px;\"><b>B. Optional Practical Training<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Unlike CPT, F-1 students may apply for <\/span><a href=\"https:\/\/www.uscis.gov\/working-united-states\/students-and-exchange-visitors\/students-and-employment\/optional-practical-training\"><span style=\"font-weight: 400;\">Optional Practical Training (OPT)<\/span><\/a><span style=\"font-weight: 400;\"> only if the employment is <\/span><b>directly related<\/b><span style=\"font-weight: 400;\"> to their major area of study. Eligible F-1 students may apply to participate in OPT as undergraduate and graduate students for <\/span><b>up to 12 months<\/b><span style=\"font-weight: 400;\"> at each level.<\/span><\/p>\n<p><b>Note:<\/b><span style=\"color: #ff0000;\"><span style=\"font-weight: 400;\"> OPT is <\/span><i><span style=\"font-weight: 400;\">not<\/span><\/i><span style=\"font-weight: 400;\"> an option for <\/span><span style=\"font-weight: 400;\">F-1 students in English language training programs.<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you are eligible for OPT, you may apply either during your program of study (pre-completion OPT) or after completing your studies (post-completion OPT).<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>Pre-completion OPT<\/b><span style=\"font-weight: 400;\">: You may apply for up to 12 months of pre-completion OPT only after you have <\/span><span style=\"font-weight: 400;\">been enrolled in school for one full academic year. Once you are authorized, you may work up to 20 hours per week while school is in session. You may work full-time when school is not in session. <\/span><\/li>\n<\/ul>\n<p><b>Note:<\/b><span style=\"font-weight: 400;\"><span style=\"color: #ff0000;\"> Keep in mind that your OPT period at each level of education (undergraduate and graduate) is capped at 12 months, so any time spent on pre-completion OPT will be deducted from the available period of post-completion OPT.<\/span> For example, if you have 2 months of pre-completion OPT experience, you will only be eligible for a maximum of 10 months for post-completion OPT.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>Post-completion OPT<\/b><span style=\"font-weight: 400;\">: F-1 students authorized for post-completion OPT may work part-time (at least 20 hours per week) or full-time. <\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Here\u2019s what you need to do to <span style=\"color: #ff0000;\">get authorization for OPT<\/span>:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You must obtain your DSO\u2019s approval. Your DSO can authorize an OPT employment for you in <\/span><a href=\"https:\/\/www.ice.gov\/sevis\"><span style=\"font-weight: 400;\">SEVIS<\/span><\/a><span style=\"font-weight: 400;\"> and provide you with an updated <\/span><a href=\"http:\/\/studyinthestates.dhs.gov\/student-forms?form=Form_I-20\"><span style=\"font-weight: 400;\">Form I-20<\/span><\/a><span style=\"font-weight: 400;\">, \u201cCertificate of Eligibility for Nonimmigrant Status,\u201d <\/span><span style=\"font-weight: 400;\">that shows DSO approval for OPT employment.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Once you have the new Form I-20, you must file a <\/span><a href=\"https:\/\/www.uscis.gov\/i-765\"><span style=\"font-weight: 400;\">Form I-765<\/span><\/a><span style=\"font-weight: 400;\">, \u201cApplication for Employment Authorization,\u201d along with supporting documents within 30 days of receiving your recommendation. You must also pay the requisite fee to USCIS.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">If USCIS approves your application, you will receive a <\/span><a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/employment-authorization-document\"><span style=\"font-weight: 400;\">Form I-766<\/span><\/a><span style=\"font-weight: 400;\"> (EAD), which will specify the dates that you may work. Please note that you may not commence OPT work before you receive your EAD.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">How far in advance can you get the process going? That depends on whether you are applying for pre-completion or post-completion OPT.<\/span><\/p>\n<table>\n<tbody>\n<tr>\n<td><strong>Pre-completion OPT<\/strong><\/td>\n<td><span style=\"font-weight: 400;\">You may apply up <\/span><span style=\"font-weight: 400;\">to 90 days before you complete your full academic year, but you may not start working until after you complete one full academic year.<\/span><\/td>\n<\/tr>\n<tr>\n<td><strong>Post-completion OPT<\/strong><\/td>\n<td><span style=\"font-weight: 400;\">You may apply up <\/span><span style=\"font-weight: 400;\">to 90 days before you complete your degree. <\/span><\/p>\n<p><b>Note:<\/b><span style=\"font-weight: 400; color: #ff0000;\"> The deadline is 60 days after completing your degree.<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3 style=\"padding-left: 40px;\"><b>C. Science, Technology, Engineering and Mathematics (STEM) OPT Extension<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">F-1 students earning a STEM degree may be eligible for the <\/span><a href=\"https:\/\/www.uscis.gov\/node\/50598\"><span style=\"font-weight: 400;\">STEM OPT<\/span><\/a><span style=\"font-weight: 400;\"> extension &#8212; a 24-month* extension of their post-completion OPT &#8212; if they meet other specified requirements. <\/span><\/p>\n<p><b>*Note:<\/b><span style=\"font-weight: 400;\"><span style=\"color: #ff0000;\"> This 24-month extension is effective as of March 11, 2016, replacing a prior 17-month extension program.<\/span> Students who are currently on a 17-month STEM OPT should check <\/span><a href=\"https:\/\/www.uscis.gov\/node\/50598\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\"> for instructions on how to apply for seven additional months.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You may qualify for the 24-month extension if you meet the following conditions: <\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You have been granted OPT and are currently in a valid period of OPT;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You have received a STEM degree at a bachelor\u2019s, master\u2019s, or doctoral level from a currently accredited and SEVIS-certified school, and you are seeking OPT employment that is directly related to your degree;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Your prospective employer uses the <\/span><a href=\"https:\/\/studyinthestates.dhs.gov\/understanding-e-verify\"><span style=\"font-weight: 400;\">E-Verify<\/span><\/a><span style=\"font-weight: 400;\"> program; and<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">You and your prospective employer have completed and signed <\/span><span style=\"font-weight: 400;\">the <\/span><a href=\"https:\/\/studyinthestates.dhs.gov\/form-i-983-overview\"><span style=\"font-weight: 400;\">Form I-983<\/span><\/a><span style=\"font-weight: 400;\">, \u201cTraining Plan for STEM OPT Students.<\/span><span style=\"font-weight: 400;\">\u201d<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Here\u2019s what you need to do to <span style=\"color: #ff0000;\">get authorization for STEM OPT extension<\/span>:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">You must obtain your DSO\u2019s approval. Once your DSO verifies that you have a completed Form I-983, you will be provided with an updated <\/span><a href=\"http:\/\/studyinthestates.dhs.gov\/student-forms?form=Form_I-20\"><span style=\"font-weight: 400;\">Form I-20<\/span><\/a><span style=\"font-weight: 400;\">, \u201cCertificate of Eligibility for Nonimmigrant Status,\u201d <\/span><span style=\"font-weight: 400;\">that shows DSO approval for STEM OPT extension.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Once you have the new Form I-20, you must file a <\/span><a href=\"https:\/\/www.uscis.gov\/i-765\"><span style=\"font-weight: 400;\">Form I-765<\/span><\/a><span style=\"font-weight: 400;\">, \u201cApplication for Employment Authorization,\u201d along with supporting documents within 60 days of receiving your recommendation. You must also pay the requisite fee to USCIS.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If USCIS approves your application, you will receive a <\/span><a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/employment-authorization-document\"><span style=\"font-weight: 400;\">Form I-766<\/span><\/a><span style=\"font-weight: 400;\"> (EAD), which will specify the dates that you may work.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>How far in advance can you get the process going? <\/strong><\/p>\n<p><span style=\"font-weight: 400;\">You may apply up <\/span><span style=\"font-weight: 400;\">to 90 days before you complete your degree. The deadline for application is 60 days after completing your STEM degree.<\/span><\/p>\n<p><strong>What if your initial post-completion OPT period expires while your STEM OPT extension application is pending?<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">If you file your STEM OPT extension application on time and your initial post-completion OPT period expires while your extension application is pending, you may continue to work for up to 180 days after your EAD expires.<\/span><\/p>\n<p><span style=\"font-weight: 400; color: #ff0000;\">Recipients of a <\/span><span style=\"font-weight: 400;\"><span style=\"color: #ff0000;\">STEM OPT extension have reporting responsibilities<\/span> under the law. If you have received a 24-month extension, you are required to report to your DSO as follows:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Report changes to your legal name, residential or mailing or email address, employer\u2019s name and address, or loss of employment,* within 10 days of the change; and<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Confirm existing information every six months if there are no changes.<\/span><\/li>\n<\/ul>\n<p><b>*Note:<\/b><span style=\"font-weight: 400; color: #ff0000;\"> STEM OPT extension recipients are allowed to be unemployed for up to 150 days in total.<\/span><\/p>\n<h2><b>4. Program post-completion caveat<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">What should F-1 students do after completing their program?<\/span><\/p>\n<p><b>Always be mindful to maintain your visa status. <\/b><span style=\"font-weight: 400;\">If you are on an F-1 visa and have completed your program of study and any authorized period of practical training, you have 60 days after the program end date on your Form I-20 to leave the United States. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you wish to <span style=\"color: #ff0000;\">extend your stay<\/span> without violating your status, you should talk to their DSO and consider other options, such as transferring to another school, changing the level of education you are pursuing, and changing your visa status.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Students with an F-1 student visa should not commence work, either on or off campus, without first consulting their designated school official (DSO).
